These Terms and Conditions ("Terms") govern your access to and use of the ClearRank website, platform, APIs, feeds, and related services (the "Service").

ClearRank is an independent software project operated by an individual based in Germany ("ClearRank", "we", "us").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1 Nature of the Service Important

ClearRank is an experimental AI visibility and analytics tool designed to help users observe, generate, and monitor machine-readable signals related to how brands or products may appear in AI-generated answers.

ClearRank:

  • Does not control any AI system, search engine, or crawler
  • Does not guarantee visibility, ranking, citation, traffic, or business outcomes
  • Provides analytical and informational data only

⚠️ Use of the Service is at your own risk.

2 Eligibility

  • You must be at least 18 years old and legally permitted to use online services in your jurisdiction.
  • If you use the Service on behalf of an organization, you confirm you are authorized to do so.

3 Accounts & Access

You are responsible for:

  • Keeping your credentials secure
  • All activity under your account
  • Ensuring submitted data is accurate and lawful

We may suspend or terminate access at any time to protect the Service, its users, or legal compliance.

4 User Content & Data

  • You retain ownership of all data and content you submit.
  • By using ClearRank, you grant us a limited, non-exclusive, worldwide license to process, host, cache, and analyze your data solely to operate and improve the Service.
  • You confirm that you have the right to submit all provided content.

5 Third-Party Systems & AI Engines Important

ClearRank interacts with or references third-party AI systems and crawlers (e.g. large language models, search engines, bots).

ClearRank:

  • Does not operate or influence these systems
  • Cannot ensure how, when, or whether they process your data
  • Is not responsible for changes, errors, omissions, or behavior of third parties

Any metrics, scores, or insights are best-effort estimates, not guarantees.

6 Acceptable Use

You may not:

  • Use the Service for unlawful or deceptive purposes
  • Attempt to manipulate or abuse AI systems
  • Interfere with infrastructure, security, or availability
  • Reverse engineer or scrape the Service

Abuse may result in immediate suspension.

7 Fees

Some features may be paid.

All payments are:

  • Billed in advance
  • Non-refundable unless required by law

We may change pricing or features at any time.

8 Availability & Changes

The Service is provided "as is" and "as available."

  • We may modify, suspend, or discontinue any part of the Service without notice.
  • Data loss, downtime, or changes in functionality may occur.

9 Disclaimer of Warranties

To the maximum extent permitted by law:

  • The Service is provided without warranties of any kind, including accuracy, fitness for a particular purpose, or uninterrupted availability.
  • ClearRank makes no promises of performance, improvement, or results.

10 Limitation of Liability

To the maximum extent permitted by law:

  • ClearRank shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, visibility, or business opportunity.
  • If liability cannot be excluded, total liability is limited to €100.

11 Indemnification

You agree to indemnify and hold ClearRank harmless from claims arising from:

  • Your use of the Service
  • Your data or content
  • Violations of these Terms or applicable law

12 Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate access at any time without liability.

13 Governing Law & Jurisdiction

  • These Terms are governed by the laws of Germany.
  • Exclusive jurisdiction is the courts of Germany.
